Divorce Decree Modification

Overview

Divorced couples often continue to disagree even after a divorce is finalized. In some cases, a divorce decree modification may be the best way to reach a solution. Divorce decree modifications can take place if the circumstances of one party have changed significantly, making the terms of the divorce unfair.

These circumstances can be financial, personal, or work-related. Common issues for divorce decree modifications include: child support, custody, parenting time, and spousal maintenance. Any property divided during the divorce is final and cannot be modified absent a showing of fraud, undue influence, or some other extraordinary reason.

Our Minnesota divorce attorneys can help you determine if a motion to modify your divorce decree is the right choice based on your specific circumstances. At Alithis Family Law, our lawyers pride themselves on how they serve our clients. Custody / Parenting Time Modification

Modification of parenting time can mean conditional parenting time or in certain instances, suspension of parenting time. Once a parenting time order is issued, either through a Divorce Decree, a Paternity Order, or a Custody Order, either parent may bring a motion before the court to change the existing parenting time schedule.

Divorce Appeal

If you disagree with the court’s decision at trial in your divorce case, the ruling may be appealed. The process begins at the Minnesota Court of Appeals where it is reviewed for the following qualifications:

Spousal Maintenance (Alimony) Modification

If you are no longer satisfied with the spousal maintenance award outlined in your divorce Decree, a spousal maintenance modification may be an option for you.
